Here at Shop Your Own Mortgage (“SYOM”, “We”, “Our”, “Us”), we like to knock before we enter, to ask for permission before we borrow, and to update you on our progress as we move through the stages of helping you get a mortgage. As a result of our transparent process, you will always have a clear idea of who is viewing your documents or how your information is being used. As a matter of fact, our team members take pains to constantly communicate with you about how your documents are being collected and how they are being used. Our process is also outlined for your convenience in this Privacy Policy (“Privacy Policy”) so that you have a permanent reference for how we at, SYOM, help maintain your privacy. 

 This Privacy Policy covers the collection, use and disclosure of information collected through our website www.syomortgage.com (the “Website”) and the mobile applications owned and operated by SYOM (collectively the “Service”).  It also describes the choices available to you regarding our use of your personal information (“Personal Data”) and how you can access and update this information.  The use of information collected through our services shall be limited to the purpose of providing the Service for which we have been engaged by our clients and partners.

Scope:

This Privacy Policy applies only to Personal Data collected by SYOM through the Website, software, mobile app installation or use or visitation to any other SYOM corporate websites, or where this Privacy Policy is posted, and does not apply to any other information collected by SYOM through other means. This Privacy Policy describes our information collection and sharing practices with respect to visitors to our website and loan applicants (“Guests”).

Information We Collect

This section of the Privacy Policy describes the categories of information we collect about Guests, and how we use that information. The types of information we collect from our Guests depend on the purpose for which each Guest chooses to use the Services.  We collect the following categories of information about Guests:

  • When a Guest creates an account to use the Services, we collect their name, email address and address.
  • When a Guest initiates and completes a loan application through the Service, we collect information provided by Guests that is required by the lender to process each application (collectively, “Loan Application Information”). We use Loan Application Information to evaluate, process, and underwrite the loan application. We will also retain and use Loan Application Information in our capacity as a service provider to a lender, including to establish and administer loan accounts, protect Guests from fraud, and to satisfy certain regulatory requirements. Our collection, use and disclosure of Loan Application Information will comply with the lender’s privacy policy and applicable law. We may supplement the Loan Application Information with information from other sources, such as credit bureaus. All supplementary information is treated as Personal Data when it directly or indirectly identifies the Guest.
  • When a Guest submits a request for support, we may collect the following types of Personal Data: name, telephone number, email address and other information that the Guest chooses to give us to respond to the support request.
  • We automatically collect the date and time of the Guest’s access to the Services. Depending on the settings of a Guest’s computer or mobile device (“Device”), we may also automatically collect: Device make, model, screen resolution, plug-in information, language preference, browser type; mobile operating system type and version; country and time zone in which the Device is located, geolocation data, Wi-Fi networking connection data, Internet Protocol (IP) address, metadata stored on the Device; time stamped logs regarding access times and duration of visits; the method by which you got to our website (such as by an advertisement, our social media channels, etc.) and other information. This information is collected through cookies and/or flash stored objects (FSOs).

How We Use Collected Information

We use personal information for the following purposes:

  • To complete your loan application;
  • To respond to and meet your requests;
  • For our marketing efforts, such as to send you marketing communications that we believe may be of interest to you;
  • For our business purposes, such as for analysis and to develop new products and services;
  • To send information including confirmations, technical notices, updates, security alerts, support, and administrative messages;
  • To protect, investigate, and deter against fraudulent, unauthorized, or illegal activity; 
  • To improve the Service; or
  • For any other purpose to which you consent

How We Share Personal Information

This section of the Privacy Policy describes how we share the Personal Data we collect about Guests. The following are the ways we disclose or share Personal Data about Guests:

    • Access to Information by Employees.  SYOM personnel may access and use Personal Data only if they are authorized to do so and only for the purpose for which they are authorized.
    • Access to Information by Service Providers. We may share Personal Data with service providers with whom we have contracted to perform services on our behalf, such as companies that help us process and service loans, and, where permitted by law, companies that help us market products and services. All contracted third-party service providers are contractually required to safeguard all Personal Data.
    • Sharing Aggregated Information. We may share aggregated Personal Data that is not identified with any particular Guest with our business partners and our affiliates.
    • Sharing Loan Application Information with Lenders and Cosigners.  We will share Loan Application Information with the applicable lender. If the lender directs us to do so, we may also share Loan Application Information and related Personal Data with other service providers who support the lender’s loan programs, such as loan servicing companies, collection agencies and credit bureau agencies. We limit the information that we send to service providers such as credit reporting agencies (that run your credit score) and require that our service providers only use your personal information to perform/for the services requested (in accordance with this Privacy Policy). We also screen our providers to ensure they have adequate security measures in place to protect your personal information/security.  For example, after you’ve authorized us to verify your credit history, we will send the minimal set of information needed (including your social security number) to a credit bureau. By including your social security number, we ensure that we are requesting the correct credit report and associated credit history data in an encrypted form. We would not send the same level of information to a service provider when it is not necessary. If two applicants apply for a loan together as borrower and cosigner, each applicant will have access to the other’s Loan Application Information. Guests should review their lender’s privacy policy for more information about that lender’s specific information sharing practices.
    • Sharing Loan Application Information to Complete Loan Application.  We may share Loan Application Information as necessary to complete the loan application, including without limitation, receiving employment verification, degree verification, title, document import, or other necessary services.
    • Corporation Transactions. In the event that we enter into a corporate transaction, such as a reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings), personal information that we have collected may be transferred in the course of that corporate transaction to the relevant third party purchaser, joint venture partner, merged entity, assignee or similar party.
    • Compliance with Laws or Response to Legal Process.  Under certain circumstances, we may be required to disclose Personal Data (i) in response to valid requests by public authorities, including for national security, law enforcement, or regulatory requirements, (ii) in response to any legal process served on SYOM or any applicable lender, (iii) to protect the rights or property of SYOM or any applicable lender.

In any case, where we have received your Personal Data and subsequently transferred it to a third party acting as an agent on our behalf (onward transfer), we remain liable under the Principles.  The third parties we work with must also abide by the Principles and their compliance is incorporated into our contracts with them. We remain liable should your personal information be processed by our agent in a manner inconsistent with the Principles, unless we prove that we are not responsible for the event giving rise to the damage.

SYOM does not disclose personal information to third parties for purposes that are materially different than what it was originally collected for. Should this change in the future, we will provide individuals with the option to opt-out.

By submitting a loan application or a request to be pre-qualified, you authorize us to share your credit report with our affiliates solely for the purpose of processing your loan application.

Newsletter and Email Communication 

We give you the opportunity to subscribe to Email newsletters and other Email communications. However, if you don’t feel like seeing some amazing content, you can easily unsubscribe from any future marketing contacts from us at any time by clicking “Unsubscribe” or by following the instructions provided in each Email newsletter or by contacting us via the email address or phone number given on our website and requesting to be taken off our list.  If you opt out, we may still send you non-marketing emails. Non-marketing emails include emails about your account and our business dealing with you.

Interactive Help (Chat) 

You may initiate an online interactive discussion, or a “live chat” with a SYOM support professional. You should feel free to use this resource at any time to ask for help, request more information, share your concerns, etc. We do not require that you provide any personally identifiable information to use this service; if you volunteer personally identifiable information, however, it will only be used to respond to your request. We maintain transcripts of chat sessions for quality assurance and recording purposes.

How We Protect Personal Information

SYOM uses reasonable physical, technical, and administrative security measures to protect Personal Data we collect from loss, misuse, unauthorized access, or improper disclosure. For example, we use encryption technologies when transmitting information to and from the Website and with our third-party service providers. Please understand that no security technology is completely secure, and remember that when communicating with SYOM, email is not a secure form of communication when transmitting sensitive or personal information. That is why we advise using our mobile app which is protected with encryption to send all documents.  Despite these precautions, no data security safeguards guarantee 100% security all of the time.

The Website may contain links to third-party websites, such as social media websites. This Privacy Policy is only applicable to this Website, and SYOM has no control over these third-party websites’ informational practices. Please be sure to review these third-party websites’ privacy policies before visiting these third-party websites.

Children’s Privacy

The Service is not intended for persons under the age of 18. We do not knowingly collect, maintain, or use personal information from children under the age of 13. If we become aware that a child under the age of 13 has submitted personal information to us through the Service, we will immediately delete such information.

Access to Information

A Guest whose Personal Data is covered by this Privacy Policy has the right to access his or her Personal Data and to correct, amend, limit the use of, or delete the Personal Data if the Personal Data is inaccurate or processed in violation of the Principles. Notwithstanding the foregoing, we are not required to grant the rights to access, correct, amend and delete Personal Data if the burden or expense of providing access, correction, amendment or deletion is disproportionate to the risks to the Guest’s privacy or if the rights of persons other than the Guest are or could be violated.  SYOM will endeavor to respond in a timely manner to all reasonable written requests to view, modify, or inactivate Personal Data. 

Updates to this Privacy Policy

We reserve the right to update this Privacy Policy at any time consistent with the Principles and applicable data protection and privacy laws and principles. We will make employees aware of changes to this policy either by posting to our intranet, through email, or other means. We will notify Guests if we make changes that materially affect the way we handle Personal Data previously collected, and we will allow them to choose whether their Personal Data may be used in any materially different manner.  Any changes will be immediately effective upon the posting of the updated policy. Your continued use of the Services after these updates are posted represents your consent to the terms of the new Privacy Policy.
